One Jan 6 case has been prosecuted in total secrecy--feds have sealed all the records

Hundreds of Americans were jailed without charge or bail for merely walking by the capitol building on January 6th.  Later over 200 have been convicted and sentenced to prison for up to 22 years.

As bizarre as all those cases are, Sam Lazar's is even more bizarre, as he seems to have been charged, tried, convicted and sentenced in total secrecy.

Even after Lazar was released from federal prison in July, every record in his case is still sealed--kept secret, with both the feds and his own attorneys refusing to offer any explanation, even after the end of his alleged prison sentence.

Lazar was arrested in July 2021, but there is no public record of any trial, conviction or sentence in the public court docket.

The only official statement in the case is from the federal Bureau of Prisons, which said he'd been sentenced in federal court in DC "on March 17th" (no year given) to 30 months.  However, there’s no public record of such a hearing.  But if that's accurate, and this year (as it apparently is), and he was released in July, he could only have served a bit over four months.

The Bureau says he'd been in prison since July 2021.  But since that was when he was arrested, he obviously couldn't have been convicted the same month.  But since all records in the case are sealed, there's no way to know the date of his trial (if any) and sentencing.
 
Questions about Lazar’s case have been swirling for months, but the government refuses to release a single detail of his alleged trial, conviction and sentence.

To make the case even more strange, Lazar's own attorneys haven't responded to multiple requests for comment.  This is astonishingly unusual, as even if the charges were secret, it's unheard of for the judge to order the attorneys not to reveal even the date of the (alleged) trial or sentencing.

In May the judge in the case rejected a request from media outlets to release all sealed records in the case.

The case has "raised more concerns" about transparency in the ghastly, hideous jailing of Jan 6 demonstrators without bail for up to two years, and in many cases without being charged for over a year.  Also the sentences have been far out of proportion--as if the feds were trying to intimidate others.

With the exception of national security cases (spying), records of court hearings--including sentencing hearings and plea agreements—are supposed to be open and available to the public.  

Secret plea hearings are not unheard of, but this level of secrecy is almost unprecedented.  So why all the secrecy in this case?

In July of this year a spokeslackey for the federal Bureau of Prisons said Lazar was transferred from the federal lockup at Fort Dix, New Jersey, to “community confinement” overseen by the Bureau of Prisons, meaning he was either in home confinement or a halfway house.

A social media post from Lazar's sister in July  shows Lazar standing outside waving an American flag with the caption: “Hallelujah Praise God free at last.”

A former federal prosecutor said he couldn't remember any case in which a sentencing hearing and sentence were placed under seal. He speculated that either there was a security concern about him, or that he could be cooperating with the feds and they don’t want the people he’s cooperating against to know.

The former prosecutor added that “The fact that he got sentenced, went to prison and is already out, that whole situation is extremely unusual.”

Back in 2021 Judge Robin Meriweather in D.C ordered Lazar jailed without bail until trial, ruling that he posed a threat to public safety. The judge also noted that Lazar been photographed posing with firearms on a public street during an August 2020 rally.  This is odd since Americans now have the right to openly carry in many states.

In January 2022 the feds produced a new indictment charging Lazar with five counts, including felonies.  So he hadn't yet gone to trial for anything earlier.  He pleaded not guilty in February of 2022.  In March, prosecutors and Lazar's attorney asked for more time “to negotiate a disposition of the matter short of trial.”

In June 2022, U.S. District Judge Amy Berman Jackson canceled a status conference for Lazar's case "because he wasn't available to appear by video from jail."  This is highly unusual since if he was in jail, he was available.  If the video link hadn't been working one would think that would have been the cited reason.

That's the last publicly available court filing to address the status of the case.  So as of March of 2022 he hadn't gone to trial.  And as we'll see below, sources say he wasn't sentenced until at least March of this year.

Hmmm....

In April of this year, attorneys for several news outlets asked the judge to unseal any records related to a change of plea or sentencing hearing for Lazar, noting a March NBC News story—citing an anonymous source—saying Lazar was scheduled to be sentenced in a secret hearing.

Note the date: If he hadn't been sentenced until April of this year, and was freed to home confinement in July, either he was NOT sentenced to 30 months, as alleged, OR he was released after serving barely three months of his sentence.

In May Judge Jackson denied the news outlets' request to release the records, after *both* a prosecutor and defense attorney argued against releasing them.  That's...odd.

Jackson said there were no “undocketed” records in this case, and that "nothing has been sealed in this case without leave of court."  That's a huge loophole.

Okay: It's seems pretty clear that Lazar has been cooperating with Garland's gestapo, hoping for a lighter sentence.  I suspect the gestapo told him if he gave evidence against everyone charged, he'd get two years from the first day he was arrested--which is what happened.

What I have a problem with is the unprecedented secrecy in keeping all the court records sealed.  This is repugnant to an honest, ethical government--meaning it's absolutely unsurprising for the biden regime.Source.
